Family Lawyers: When Do You Need Them?

Law Blog

There are times when families require the services of family lawyers or a court of law to help settle their disputes. You need to know such times so that you can understand how a family lawyer can be of assistance to you.

1. Wills and Deceased Property Settlement

Even though life is precious, at some point, everyone unfortunately dies. If you have accumulated a lot of wealth, it is recommended that you leave a will to prevent disputes within your family and to prevent other unknown persons from claiming your family's wealth. Seek out a family lawyer who specialises in wills. They'll guide you through the entire process and inform you of the requirements and how you can amend the will as circumstances change.

2. Divorce

This is the most common reason that leads couples to search for family lawyers. They might first recommend that you try to come to terms peacefully without going to court because lengthy court processes lead to wastage of money, a bitter person at the end (the one who loses) and emotional turmoil for you and your children if you have any. Even if you have an amicable divorce, it is wise for each person to consult their own family lawyer. They are experienced enough to know more about issues that may arise before, during, and after a divorce. With their counsel, you can get ahead of such issues.

3. Child Custody and Marital Property Settlement

Most family lawyers who specialise in divorce might also specialise in child custody and settlement of the marital property. Usually, when a couple has a bitter divorce, one may claim child custody and a large portion of the marital property. A family lawyer steps in to ensure that the best interests of the child or children are observed and that there is a fair distribution of marital property. This is achieved by carrying out detailed investigations on the cause of the divorce and how each party contributed to the accumulation of the property.

4. Prenuptial and Postnuptial Agreements

Before getting married, it is important to establish prenuptial agreements. They mainly address the issues of wealth and what should happen if a divorce were to occur. Postnuptial agreements are drawn up if prenuptial agreements were not drawn up before the marriage. They address the same concerns as prenuptial agreements, the only difference being that they are drawn after marriage instead of before.
